1. About these terms
These Terms of Use apply to the public Auditray website at www.auditray.com, operated by Vardot for Programming and Vardot, LLC (together, “Vardot”, “we”, “us”, or “our”). Please read them before using the website. By using the website, you agree to these terms to the extent permitted by applicable law. If you do not agree, please stop using it.
2. Website and application scope
The website provides information about Auditray, a website governance platform for organizations managing multiple websites. “Explore Auditray” links direct you to app.auditray.com.
Access to the application, subscriptions, customer data processing, support, and other services is subject to the separate agreements, orders, and service terms applicable to your organization. These website terms do not create a subscription, establish prices or refunds, or replace a signed customer agreement. In a conflict about contracted services, the applicable signed agreement controls.
3. Acceptable use
You may use this website for lawful informational and business purposes. You must not:
- Use it to commit fraud, impersonate another person, or violate another person’s rights.
- Attempt unauthorized access to systems, accounts, or data, or bypass access restrictions.
- Introduce malicious code, interfere with availability, or use automated requests in a way that disrupts the website.
- Copy or exploit protected website content beyond permissions granted here or rights provided by law.
Any assessment of a website using the Auditray application must be authorized by the owner or another party with authority to permit it and remains subject to the applicable service terms. Report security concerns responsibly through Vardot’s security reporting guidance.
4. Intellectual property
The Auditray and Vardot names, branding, website design, text, and other protected materials belong to Vardot or their respective licensors. You may view and share links to public pages and retain copies for lawful internal reference, preserving copyright and attribution notices. No ownership or trademark license is transferred by website use. Statutory exceptions and applicable open-source licenses remain unaffected.
Third-party names and logos belong to their respective owners. Their appearance does not grant you rights to use them or establish an endorsement beyond any expressly described relationship.
5. Information you provide
Provide accurate information when contacting us and do not send content you lack authority to share. You retain ownership of your information. Sending an enquiry allows us to use it to respond and handle the requested communication, subject to our Privacy Policy. Customer data rights and processing in the application are governed by the applicable customer agreements, not a broad license under these website terms.
6. Third-party websites and services
Links may lead to third-party websites, resources, or services. Their operators control their content, availability, terms, and privacy practices. Review those terms before use. A link is provided for convenience and does not make us responsible for a third party’s services.
7. Informational content and professional review
Website content describes Auditray’s general purpose and is not legal advice, a compliance certification, or a guarantee that all security or accessibility issues will be found. Product illustrations are explanatory, not a promise that every depicted capability is included in your service.
Auditray supports governance and specialist review; it does not replace qualified security, accessibility, or legal professionals. Your organization remains responsible for its decisions, authorizations, and compliance obligations. Actual service scope is determined by applicable documentation and agreements.
8. Availability and disclaimers
We aim to keep website information useful and accurate, but it may contain errors or become outdated. We may update, maintain, or discontinue website content. To the extent permitted by law, the public website is provided “as is” and “as available”, without a guarantee of uninterrupted access, completeness, or fitness for a particular purpose.
These disclaimers do not change express commitments in a separate customer agreement or exclude warranties and rights that cannot lawfully be excluded.
9. Limits of responsibility
To the extent permitted by applicable law, Vardot is not responsible for indirect or consequential loss arising from use of, or inability to use, this public informational website, including loss of anticipated profits or business opportunities. This does not exclude or limit liability for fraud, deliberate misconduct, or any liability that cannot legally be excluded or limited. Any liability terms for contracted services are set out in the applicable agreement.
10. Protecting website access
We may restrict access reasonably necessary to address misuse, security threats, unlawful activity, or legal obligations. This provision concerns public website access; suspension or termination of a contracted application service is governed by the applicable service agreement.
11. Changes and applicable rights
We may revise these terms and post the updated version with a new “Last updated” date. Additional notice will be provided where required by law. Revisions do not retroactively amend a signed customer agreement.
Nothing in these terms removes mandatory rights or protections available under applicable law. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
12. Contact
For questions about Auditray or these terms, contact Vardot through its contact page. Privacy questions and rights requests can be sent to privacy@vardot.com.
